Synopsis: ABOUT 10:55 P.M. EASTERN DAYLIGHT TIME ON MAY 14, 1988, A PICKUP TRUCK TRAVELING NORTHBOUND IN THE SOUTHBOUND LANES OF INTERSTATE 71 STRUCK HEAD-ON A CHURCH ACTIVITY BUS TRAVELING SOUTHBOUND IN THE LEFT LANE OF THE HIGHWAY NEAR CARROLLTON, KENTUCKY. THE CHURCH BUS FUEL TANK WAS PUNCTURED DURING THE COLLISION SEQUENCE, AND A FIRE ENSUED, ENGULFING THE ENTIRE BUS. THE BUSDRIVER AND 26 BUS PASSENGERS WERE FATALLY INJURED. THIRTY-FOUR BUS PASSENGERS SURVIVED WITH MINOR TO CRITICAL INJURIES, AND SIX WITH NO INJURIES. THE PICKUP TRUCK DRIVER SUSTAINED SERIOUS INJURIES.
Recommendation: THE NTSB RECOMMENDS THAT THE STATE OF KENTUCKY: EXPAND THE USE BY THE KENTUCKY STATE POLICE OF PRELIMINARY BREATH TEST DEVICES AND THE THREE-PART FIELD SOBRIETY TEST RECOMMENDED BY THE NATIONAL HIGHWAY TRAFFIC SAFETY ADMINISTRATION, INCLUDING THE HORIZONTAL GAZE NYSTAGMUS TEST, AND URGE AND ASSIST ALL OTHER TRAFFIC LAW ENFORCEMENT AGENCIES IN KENTUCKY TO DO THE SAME.

Response: THE BOARD UNDERSTANDS THAT THE KENTUCKY STATE POLICE HAVE EXPANDED THE USE OF PRELIMINARY BREATH-TESTING DEVICES & THAT ADDITIONAL PRELIMINARY BREATH-TESTING DEVICES HAVE ALSO BEEN PURCHASED. BASED ON THIS INFO, H-89-11 HAS BEEN CLASSIFIED AS "CLOSED--ACCEPTABLE ACTION.

Response: THE KENTUCKY STATE POLICE ARE EXPANDING THE USE OF PRELIMINARY BREATH TESTING DEVICES. OVER THE PAST YEAR 120 PBTS WERE PURCHASED & THEY WILL SOON BE PURCHASING AN ADDITIONAL 90 PBTS FOR THE STATE TROOPERS. THE KENTUCKY JUSTICE CABINET IS ALSO PROVIDING GRANTS TO LOCAL LAW ENFORCEMENT AGENCIES FOR PURCHASES OF PTS. THE KENTUCKY STATE POLICE & THE DEPARTMENT OF CRIMINAL JUSTICE TRAINING HAVE ADOPTED THE THREE-PART FIELD SOBRIETY TEST RECOMMENDED BY THE NHTSA. NO OTHER FIELD SOBRIETY TESTING IS BEING TAUGHT TO LAW ENFORCEMENT OFFICERS IN KENTUCKY & WE HAVE URGED THAT NO OTHER FIELD SOBRIETY TEST BE USED IN DUI INVESTIGATIONS.
