Details
Synopsis: In November 2016, the NTSB began the investigation of two crashes involving school buses. Each crash was initiated when the driver lost control of the bus. In the November 1 crash in Baltimore, Maryland, the driver was epileptic and suffered a seizure. In the November 21 crash in Chattanooga, Tennessee, the driver was speeding while using a cell phone and ran off the road. In both cases, the school bus operators were private for-hire motor carriers. Although the specific safety issues differed, the crashes shared one common factor: poor driver oversight by both the school districts and the contracted motor carriers, which resulted in unsafe operation of the school buses. Between the two crashes, 12 people died and 37 were injured. The crash investigations focused on the following safety issues: school districts’ lack of oversight of student transportation providers; poor management of unsafe school bus drivers by the motor carriers and school districts; medically unfit school bus drivers; commercial driver license fraud; occupant protection in large school buses; and the benefits of electronic stability control, automatic emergency braking, and event data recorders. The NTSB made safety recommendations to the Federal Motor Carrier Safety Administration; the National Highway Traffic Safety Administration (NHTSA); the states of Florida, Louisiana, New Jersey, and New York; 42 states, the District of Columbia, and the territory of Puerto Rico—which lack requirements for lap/shoulder belts on large school buses; the state of Maryland; the Maryland Department of Education; the Maryland Motor Vehicle Administration; five school bus transportation associations; National Express LLC; seven school bus manufacturers; five electronic health record companies; and Concentra, Inc. The report also reiterates four recommendations to NHTSA and reclassifies a recommendation to the Baltimore City Public Schools.

Response: We note that you consulted with your relevant state agencies, including the School Bus Safety Unit of the Kansas State Department of Education, on this issue and determined that you would not oppose future statewide legislation and local school board policy to equip new large school buses in Kansas with passenger lap/shoulder belts. We recognize and understand the concerns states and school districts have when addressing seat-belt funding and implementation; however, our investigations repeatedly show that properly worn lap/shoulder belts provide the highest level of protection for school bus passengers in all crash scenarios, including rollovers and frontal, side, and rear impacts. In addition, as we found in our Chesterfield, New Jersey, investigation, properly training school bus occupants, drivers, and parents increases successful seat belt use and emergency evacuation. We point out that such guidance was developed by delegates to the 16th National Congress on School Transportation in response to one of our recommendations in the Chesterfield report; the guidance is now publicly available at www.ncstonline.org to help those involved with pupil transportation provide the greatest safety benefit to all occupants. We are aware that a bill (HB 2008) addressing Safety Recommendation H-18-10 was introduced by Representative Swanson at the beginning of the 2017–2018 legislative session. Although we are disappointed that the bill died in committee, we commend these efforts to improve school bus safety for young Kansans, and hope that the bill will be reintroduced and well supported in the current session. We encourage you to provide leadership to ensure that the legislature passes a law addressing installation of the recommended lap/shoulder seat belts. Pending passage of the recommended legislation, Safety Recommendation H-18-10 is classified OPEN--ACCEPTABLE RESPONSE.

Response: -From Jeff Colyer, M.D., Governor: I am writing in response to your recommendation that Kansas and other states requiring the installation of lap/shoulder seatbelts on all new, large school buses. I have consulted with members of the Kansas Highway Patrol (KHP), Kansas Department of Transportation (KDOT), and the Kansas Department of Education (KSDE) on this issue. While I am confident that there are currently reasonable safety standards in place to protect Kansas children while riding in school buses, neither I nor any of the above agencies would oppose legislation requiring passenger seatbelts on buses. I would also support local school boards examining this issue to determine if it is a policy they feel important to implement within their community. This issue has been considered by the Kansas Legislature as recently as 2017 when legislation (House Bill 2008) was proposed which would require passenger seatbelts in new school buses. However, the bill died in committee and was never passed. I am including with this letter, a copy of a letter sent to KDOT by KSDE which outlines their stance and reasoning on this issue. Response: Although our expectation was that you would make this issue one of your legislative priorities, we note that you delegated responsibility for this recommendation to the MDOT MVA, which is willing to support drafting and implementing future legislation that addresses the need for occupant restraint systems on all pupil transportation vehicles in Maryland. We are aware that former Senator James Brochin introduced a bill (SB 155) in the Maryland Senate in 2017, and former Delegate Christian Miele introduced bills in the Maryland House in 2017 (HB 341) and again in 2018 (HB 1605), to address this issue. Although we are disappointed that the bills died in committee, we commend these legislative efforts to improve school bus safety for young Marylanders, and hope that the bills will be reintroduced and well supported in the 2019 session. We have copied the sponsors of these bills who have remained in the legislature for the current session. We encourage you to provide the leadership necessary to ensure that the legislature passes a law addressing installation of the recommended lap/shoulder seat belts on new large school buses. Michigan has one of the safest school bus transportation systems in the nation. Michigan House Bill No. 4045, introduced and referred to the Committee on Transportation and Infrastructure on January 18, 2017, by State Representative Robert Kosowski, requires new school buses be equipped with a safety restraint device(s). Response: We note that, in the 2015 and 2017 legislative sessions, the Oregon House considered bills requiring all school buses in Oregon to be equipped with seat belts. Although we are disappointed that neither of these bills passed, we are pleased that the Oregon Department of Education established Administrative Rule 581-053-0240 (62) allowing the voluntary installation of passenger lap/shoulder belts in school buses with a gross vehicle weight rating over 10,000 pounds, in accordance with FMVSS 222. We commend these efforts to improve school bus safety for young Oregonians and hope that a new bill will be introduced and well supported in the 2019 legislative session. Pending passage of the recommended legislation, Safety Recommendation H-18-10 is classified OPEN--ACCEPTABLE RESPONSE.

Costales, Safety Division Administrator and Traci Pearl, Highway Safety Section Manager, Oregon Department of Transportation: The Federal Motor Vehicle Safety Standard (FMVSS) 222 is the passive restraint system, built into all school buses, regardless of their size. It is commonly refe1Ted to as Compartmentalization. When students are seated properly they are protected by the confining nature of the seating system. It is very good at protecting them when school buses have a forward, or rear impact. It is this Federal Statute which exempts school buses with a gross vehicle weight rating more than 10,000 pounds from required type 2 lap shoulder belt restraints. That being said, if an Oregon local School District orders a school bus with seat belts, they may be type 2 (lap and shoulder) and they must be used by the seat occupant as outlined in Oregon Administrative Rule 581-053-240 (62). The National Transportation Safety Board began recommending school buses have lap/shoulder belts in 2016. It would be the Oregon legislature's responsibility to change the laws to require school buses to be equipped with type 2 seatbelt systems. There have been several failed attempts at passing a school bus seatbelt law over the past decade. 2017 -House Bill 3073: Requires safety belts on school buses and school activity vehicles that provide transportation for state's kindergarten through grade 12 public schools. Introduced in the House. DID NOT PASS 2015 - House Bill 2530: Requires safety belts on school buses and school activity vehicles bought after certain date. Introduced in the House. DID NOT PASS The Oregon Department of Education has established an Administrative Rule under their current statutory authority; Oregon Administrative Rule 581-053-240 (62): (62) Seat Belts: (a) Driver's seat belt: A Type 2 seat belt shall be provided for the driver, a driver's seat with an integrated Type 2 seat belt may be substituted. Each belt section shall be booted to keep belt and the button or buckle type latch off floor when not in use. Shoulder belt assemblies on Type B, C, and D buses shall provide for a height adjustment of at least four inches at its upper point of attachment to the bus. Belt shall be anchored or guided in a manner at the seat frame to prevent the driver from sliding sideways when belt is in use. Locking retractors may be either an ELR (Emergency Locking Retractor) or an ALR (Automatic Locking Retractor). All ALR equipped buses received after July 1, 1989, must include an approved anti-cinching device; (b) Passenger seat belts: (A) On buses manufactured prior to October 21, 2011 with a GVWR of more than 10,000 pounds, Type 1 seat belts or Type 2 seat belts may be installed. The attachments, belts and installation shall meet the requirements of: (i) 49 CFR 571.208 Occupant Crash Protection, 49 CFR 571.209 Seat Belt Assemblies, and 49 CFR 571.210 Seat Belt Assembly Anchorages, as they apply to school buses with a GVWR of 10,000 pounds or less; or (ii) The voluntary Type 1 or Type 2 installation requirements outlined in 49 CFR 571.222 School Bus Passenger Seating and Crash Protection that take effect on October 21, 2011. (B) On buses manufactured on or after October 21, 2011 with a GVWR of more than 10,000 pounds, Type 2 seat belts may be installed. Standards for voluntary installation of seat belts are outlined in 49 CFR 571.222 School Bus Passengers Seating and Crash Protection. (C) On buses with a GVWR of 10,000 pounds or less, mandatory seat belt standards are outlined in 49 CFR 571.222 School Bus Passenger Seating and Crash Protection. Any further policy change is up to the Oregon Legislature. The 2019 legislative session is a possible time for successful school bus seatbelt legislation. Response: The National Transportation Safety Board (NTSB) is an independent federal agency charged by Congress with investigating every civil aviation accident in the United States and significant accidents in other modes of transportation—railroad, highway, marine, and pipeline. We determine the probable cause of the accidents and issue safety recommendations aimed at preventing future accidents. In addition, we carry out special studies concerning transportation safety and coordinate the resources of the federal government and other organizations to provide assistance to victims and their family members affected by major transportation disasters. On May 22, 2018, the NTSB adopted its report Selective Issues in School Bus Transportation Safety: Crashes in Baltimore, Maryland, and Chattanooga, Tennessee, NTSB/SIR-18/02. The details of these investigations and the resulting safety recommendations may be found in the attached report, which can also be accessed at www.ntsb.gov. Among the safety recommendations is one new recommendation issued to the commonwealth of Virginia, which can be found on page 76 of the report. The NTSB is vitally interested in this recommendation because it is designed to prevent accidents and save lives.
