Synopsis: IN THE COURSE OF THE INVESTIGATION OF THE SEPTEMBER 24, 1972, ACCIDENT IN SACRAMENTO, CALIFORNIA, INVOLVING CANADAIR LTD., SABRE MARK 5, N275X, THE NATIONAL TRANSPORTATION SAFETY BOARD EXAMINED THE PILOT'S PROFICIENCY FOR THE OPERATION, THE CERTIFICATION OF EXPERIMENTAL AIRCRAFT, AND THE ASSOCIATED REGULATORY PROVISIONS. THE AIRPORT'S ENVIRONMENTAL ASPECTS, WHICH HAD A DIRECT BEARING ON THE CATASTROPHIC CONSEQUENCES OF THIS ACCIDENT, WERE ALSO CONSIDERED.
Recommendation: INCLUDE IN THE GUIDELINES DEALING WITH COMPATIBLE LAND USE PLANNING AROUND AIRPORTS, CONSIDERATION FOR THE SAFETY OF PERSONS AND PROPERTY ON THE GROUND, AND USE THE CONTROLS AVAILABLE IN THE AIRPORT DEVELOPMENT AID PROGRAM TO INSURE COMPLIANCE.

Response: FAA LTR: FAA ORDER 5100.18 (AIRPORT DEVELOPMENT AID PROGRAMMING AND PROJECT DEVELOPMENT PROCEDURES) DATED MARCH 8, 1972, PARA. 277, ENTITLED "COVENANT TO STRIVE FOR COMPATIBLE ADJACENT LAND USE," STRESSES THE NEED TO AVOID "RESIDENTIAL DEVELOPMENT AND PLACES OF PUBLIC ASSEMBLY ADJACENT TO AIRPORTS." ADDITIONALLY, ORDER 5100.18 AS WELL AS 14 CFR 152, REQUIRE THAT APPROVAL FOR FUNDING AIRPORT DEVELOPMENT PROJECTS BE CONTINGENT UPON SATISFACTORY PROOF THAT APPROPRIATE STEPS HAVE BEEN TAKEN WITH REGARD TO COMPATIBLE LAND USE IN THE IMMEDIATE VICINITY OF AIRPORTS. FAA DIRECTIVES ARE IN CONFORMANCE WITH THE BOARD'S RECOMMENDATION.
